Introduction

This is the first of a two-part series on Real Estate Law. If you don't know the difference between real estate and property, the bundle of rights, deeds, and warranties, this is the perfect place to start. This introductory course will give you the basics of US real estate law. Or should we say, real property law πŸ€“

Key Learning Outcomes

By the end of this, you will be able to:

  1. Differentiate between types of Property, including Real Estate, Real Property, and Personal Property.

  2. Use your understanding of the Bundle of Rights to evaluate which rights have been transferred and which remain with a piece of Real Property.

  3. Distinguish between types of residential tenancy, including Tenancy for Years, Periodic Tenancy, Tenancy at Will, and Tenancy at Sufferance.

  4. Identify types of Commercial Lease based on the treatment of expenses, including Gross Lease, Modified Gross Lease, Triple Net Lease, and Ground Lease.

  5. Evaluate the differences between 3 types of Equity Deed (including Warranty Deed, Grant Deed, and Quit Claim Deed).

  6. Determine which warranties are required in an Equity Deed and why.

  7. Review a Grant Deed and understand key clauses.

  8. Understand the importance of title insurance.

  9. Evaluate a Deed of Trust and understand the difference with a Mortgage.
