Introduction

This is the second and final part of the Real Estate Law series with Professor John Demas. You should have completed part 1, The Bundle of Rights, before taking this course.

The physical and legal characteristics of real estate mean that it impacts and is impacted by the rights and needs of those around it. There are limits to your rights of ownership, and third parties have rights over your land, including the government's right to take it! This module explores the limitations of ownership and the legal structures people use to acquire and own it.

Key Learning Outcomes

By the end of this, you will be able to:

  1. Differentiate between a range of rights associated with individual ownership structures, including Joint Tenants with Rights of Survivorship, Community Property, and Tenants in Entireties.

  2. Understand how specific combinations of legal structures can result in the desired outcomes around control, protection, and tax efficiency, including trusts, LLCs, LPs, GPs, and REITs.

  3. Understand the evolution of land use law through example cases.

  4. Determine where the Fifth Amendment and Eminent Domain give way to Police Powers and Environmental Laws.

  5. Evaluate controls that exist between private parties, such as Adverse Possession, and contractual controls, such as HOAs, Time Shares, etc.
